Missouri DWI law withstands high court challenge.

Defendant was convicted of Driving While Intoxicated.  He appealed on the basis that DWI laws are “void for vagueness”.  Our state supreme court affirmed the conviction, stating that an average reasonable person could understand what was meant by terms such as “intoxicated condition” and “under the influence”.   State v. Schroeder, No. 90738 (Mo. banc, January 11, 2011).
