Fleeing from the police is considered assaulting an officer

Wednesday, August 1st, 2012

Missouri statute 565.083.1(1) states that a person commits the crime of assaulting a law enforcement officer if they “recklessly” cause physical injury to the officer.  Since fleeing the cops inherently includes a “substantial and unjustifiable risk of physical injury” to any officer in pursuit, if a cop is hurt while chasing you down you can be charged with assaulting a law enforcement officer (even if you never hit the cop or ever intended any harm to the officer).

State v. Burton, No. 97224 (MO. App. E.D., July 17, 2012).
