My client was charged with the criminal offense of failing to provide adequate support to his child. The state only put up one witness that testified my client hadn’t paid the Division of Family Services the $50 a month that a previous civil/family court had ordered him to pay. I argued evidence of a failure to pay DFS is not evidence that my client isn’t providing for his child.
